Terms of Use

Welcome to HerAI and Lean In Apps. These Terms of Use ("Terms") govern your access to and use of our mobile application ("App"), operated by Epicure ("we," "us," or "our"), and any related services provided through the App. By downloading, accessing, or using our App, you agree to these Terms. If you do not agree, you must not use the App.

1. Acceptance of Terms

By using our App, you confirm that you are at least 16 years old or have reached the age of majority in your jurisdiction, and you have the legal capacity to enter into a binding agreement.

 

2. Changes to the Terms

We may update these Terms from time to time. Any changes will be effective upon posting the updated Terms in the App. Your continued use of the App after such updates constitutes your acceptance of the changes.

 

3. Description of Services

HER AI provides generative AI services powered by OpenAI GPT to deliver personalized experiences for women, including  "career advice, health tracking, personal development coaching, etc.". Our services are designed to support, not replace, professional advice.

Lean In provides salary coaching services powered by Epicure to deliver personalized experiences for salary raise negotiation. Our services are designed to support, not replace, professional advice.

 

4. Account Registration

You may be required to create an account to use certain features of the App. You agree to:

  • Provide accurate, current, and complete information.

  • Keep your login credentials confidential and notify us immediately of any unauthorized use.

  • Be responsible for all activities conducted through your account.

 

5. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy [link to Privacy Policy], which explains how we collect, use, and protect your personal data.

 

6. User Conduct

You agree to use the App only for lawful purposes and not to:

  • Violate any applicable laws or regulations.

  • Use the App to harm, harass, or discriminate against others.

  • Upload or transmit viruses or other harmful code.

  • Exploit or misuse the AI services in any unethical or illegal manner.

 

7. License to Use the App

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes. All rights not expressly granted are reserved by us.

 

8. Generative AI Disclaimer

Our App leverages generative AI technology provided by OpenAI. While we aim to provide accurate and helpful outputs, the content generated:

  • May not always be accurate, complete, or suitable for your specific circumstances.

  • Is provided "as is" without warranties of any kind. You are responsible for verifying the accuracy and appropriateness of the AI-generated content.

 

9. Prohibited Use

You must not:

  • Use the App for any purpose that violates these Terms or applicable laws.

  • Attempt to reverse-engineer, decompile, or modify the App or its AI components.

  • Use automated systems to extract data from the App without our permission.

 

10. Fees and Purchases

Certain features of the App may require payment. By making a purchase, you agree to:

  • Pay all applicable fees and taxes.

  • Use a valid payment method authorized for such transactions.

All purchases are final and non-refundable except as required by applicable law or at our sole discretion.

 

11. Intellectual Property

All content, trademarks, and intellectual property in the App, including AI-generated outputs (subject to OpenAI’s terms), belong to us or our licensors. You may not use them without prior written consent.

 

12. Termination

We reserve the right to suspend or terminate your access to the App if you breach these Terms or for any reason, at our discretion. Upon termination, all licenses granted to you under these Terms will immediately end.

 

13. Disclaimers and Limitation of Liability

  • The App is provided "as is" and "as available."

  • To the fullest extent permitted by law, we disclaim all warranties, express or implied.

  • We are not liable for any damages arising from your use of the App, including loss of data, loss of business, or personal injury.

 

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your breach of these Terms, or your violation of any rights of a third party.

 

15. Third-Party Links and Services

The App may contain links to third-party websites or services. We are not responsible for their content, privacy practices, or terms.

 

16. Governing Law

These Terms are governed by the laws of Paris, France. Any disputes will be resolved exclusively in the courts of Paris.

18. Subscription and Payment

Free and Paid Features: The App offers free basic features and premium features available through a subscription.

  • Subscription Plans: Subscriptions are billed on a recurring basis (monthly, yearly, etc.) and renew automatically unless canceled.

  • Payment: Payments are processed through the App Store or Play Store. By subscribing, you agree to the applicable terms and policies of the store platform.

  • Cancellation: You can manage or cancel your subscription through your App Store or Play Store account settings. Cancelations take effect at the end of the current billing cycle.
